Sell Study Materials Online

How did previous generations of law students study without the internet? The modern law student cannot have missed the existence of online platforms. We exchange summaries, lecture notes, past exams, assignments, and so on on a massive scale. But is it all possible?

Todays law school has changed dramatically with the Internet age. This also includes the work of lawyers: what would todays lawyer (aspirant) do without Kluwer Navigator, Legal Order and Legal Intelligence? The old case law collections that you see in libraries are starting to look more and more like artifacts. We store everything online, in the cloud. The universities offer students all documents via an online learning platform. If it werent for physical lectures, we would never really need to be on campus. However, it is the lectures that are of great importance, because this is where a hypothetical Annemiek picks up some hard knocks. Those diligent fingers that you hear tapping in the lecture hall are controlled by Annemiek, who digitizes every word the teacher utters. She has many boyfriends, because the many students who were too lazy to get out of bed for class are interested in her notorious notes.

And who is not a friend, is a customer: Annemiek uploads her notes on Knoowy , Studeersnel , and Stuvia . She gets paid for every document she uploads. But wait a minute… maybe Annemiek can also upload the elaborations of the workgroup assignments? Summaries of the prescribed literature? All her essays? Her thesis? Of course! But can you just upload everything? How about solutions manual of her textbooks? This question does not weigh heavily on the conscience of many fellow students, but we nevertheless remain curious. The main idea in answering the question is always: if the material is not yours, you must make clear who owns it. If youve read something elsewhere, you should cite the original source.

To whom do the rights of the document belong?

First, per type of document to whom the rights of the document belong.

Summaries and lecture notes With the main rule in mind, it quickly becomes clear that uploading lecture notes and summaries should not be a problem. As long as youve written these in your own words and referenced ideas that dont come from your brain, summaries are perfectly fine to upload. Otherwise you are committing plagiarism.

Study materials You have to be more careful with old exams and assignments. Employees of the universities have written these. The copyright or intellectual property here can belong to the lecturer or to the university itself. Employees employed by the university may have in their employment contract that certain rights are transferred from employee to employer. The collective labor agreement for Dutch Universities offers more freedom to arrange this transfer of rights in an individual employment contract than, for example, in the collective labor agreement for higher professional education. See article 1.20 ff and article E-7 of the collective labor agreements. Again, as long as you do not pretend to have drawn up these documents yourself, you are fine. Make sure you have permission to upload these documents. If it is not stated anywhere that it is not allowed, you can publish it. If you want to play it safe, it is best to consult the OER (Education and Examination Regulations) of your study or the study manuals and other subject information.

Solutions Manuals You can easily find student solutions manuals or instructors solutions manuals on sites such as BukLibry.com which has a cheap rate of prices compared to other book stores.

Intellectual property in theses Many students wonder about the intellectual property rights of theses. The main rule here is that the rights belong to the author of the thesis, ie the student himself. An exception to this is when you write the thesis for a company or organization in which you explicitly waive your intellectual property rights in the thesis in a contract. It is conceivable that students and companies forget to include such a clause in an agreement. In that case, the IP rights remain with the student/the student.
